Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the rustunnel.com website, the rustunnel dashboard, the rustunnel API, the rustunnel tunneling service, and any other software or services provided by rustunnel (collectively, the "Service").
By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service. You represent and warrant that you are at least 18 years old. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
These Terms incorporate our Privacy Policy, which applies to all data collected in connection with the Service.
2. Description of Service
rustunnel provides a secure tunneling service that allows you to expose local services to the internet through encrypted WebSocket connections. The Service includes:
- The rustunnel dashboard for managing tunnels and account settings.
- The rustunnel API for programmatic access.
- The rustunnel client software for establishing tunnels.
- A self-hosted version of the software, available under the AGPL-3.0 license on our GitHub repository.
The self-hosted version is governed by the AGPL-3.0 license and is not subject to these Terms. These Terms apply only to the managed Service provided through rustunnel.com.
3. Account Registration
To access certain features of the Service, you must register for an account. When registering, you agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, rule, or regulation.
- Transmit, store, or make available any content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
- Distribute malware, ransomware, viruses, worms, Trojan horses, or any other malicious code.
- Engage in phishing, spoofing, or any form of fraudulent or deceptive activity.
- Attempt to gain unauthorized access to any system, network, or data.
- Interfere with or disrupt the integrity or performance of the Service or any networks connected to it.
- Resell, rent, lease, or redistribute the Service to third parties without our prior written consent.
- Use the Service in any manner that competes with rustunnel or that could reasonably be expected to harm our business.
- Circumvent, disable, or otherwise interfere with security features of the Service.
- Use automated means (bots, scrapers, etc.) to access the Service in a manner that exceeds reasonable usage limits.
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these provisions, including terminating or suspending their account.
5. Usage Limits and Billing
The Service is offered under different plans, including a free Hobby tier and paid tiers. Usage limits and pricing are described on our website at the time of sign-up.
Paid plans are billed in advance on a monthly basis through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method automatically each billing period. You may cancel your subscription at any time through the dashboard. Fees already paid are non-refundable, except as required by applicable law.
If your usage exceeds the limits of your plan, we may bill you for overages at the rates published on our website. We reserve the right to suspend or throttle your Service if overage charges remain unpaid.
We may change our pricing with at least 14 days' notice before the change takes effect. Your continued use of the Service after the price change constitutes acceptance of the new pricing.
6. Your Content and Data
You retain full ownership of all content and data that you transmit through the Service ("Your Content"). We do not inspect, monitor, or store the content of traffic passing through your tunnels.
You grant us a limited, non-exclusive license to process, store, and transmit Your Content solely as necessary to provide the Service to you. We do not use Your Content to train machine learning models or AI systems.
You are solely responsible for ensuring that your use of the Service and any content transmitted through it complies with all applicable laws and regulations.
7. Open Source Software
The rustunnel client software and the self-hosted version are available as open source under the GNU Affero General Public License v3.0 (AGPL-3.0). You may use, modify, and distribute the open source software in accordance with the terms of the AGPL-3.0 license. Any fees charged for the managed Service do not apply to the open source version.
8. Third-Party Services
The Service may integrate with or rely on third-party services, including Stripe (payment processing), Vercel (web hosting), and Hetzner (infrastructure). These third-party services are subject to their own terms and privacy policies. We are not responsible for the practices or performance of these third-party services.
9. Termination
You may terminate your account at any time through the dashboard or by contacting us. Upon termination, your right to use the Service will cease immediately. We will delete your personal data in accordance with our Privacy Policy.
We may suspend or terminate your account immediately if you violate these Terms, engage in abusive or fraudulent activity, or for any other reason at our discretion. We will provide you with notice of termination where reasonably practicable.
The following provisions survive termination: sections 6 (Your Content and Data), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Indemnification), and 15 (Governing Law).
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not make any warranty regarding the results that may be obtained from the use of the Service. You acknowledge that your use of the Service is at your sole risk.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RUSTUNNEL AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO RUSTUNNEL IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) €100 (ONE HUNDRED EUROS).
12. Indemnification
You agree to defend, indemnify, and hold harmless rustunnel and its owners, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with:
- Your breach of these Terms.
- Your use of the Service.
- Your violation of any applicable law or regulation.
- Any content transmitted through your tunnels.
13. Publicity
Unless you instruct us otherwise in writing, we may identify you as a rustunnel user and use your name or logo in our marketing materials and on our website.
14. Changes to These Terms
We may update these Terms from time to time. We will provide at least seven (7) days' notice before any changes take effect by posting the updated Terms on this page and, for material changes, by notifying you via email. If you do not agree with the changes, you may terminate your account before the changes take effect. Your continued use of the Service after the changes become effective constitutes acceptance of the updated Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the European Union, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms shall be resolved in the courts of the jurisdiction in which rustunnel is established.
16. General
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect. These Terms constitute the entire agreement between you and rustunnel regarding the Service and supersede any prior agreements.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
